This is possible with a checkbox input and a custom field in Memberstack.

First off, thank you for submitting your feature request! 
You're correct that there's no specific data attribute or feature for adding a GDPR checkbox to a custom form, but I don't think that will stop you from adding a regular checkbox to your form with all of the appropriate settings. Curious to hear if you agree/disagree.
